# 45 m² Homes Without Planning Permission

A qualifying **32 m² to 45 m² auxiliary dwelling** may now be built without a traditional planning application, provided all Class 3A conditions are satisfied.

The home must still comply fully with Building Regulations, Building Control procedures, BER requirements, fire and structural standards, ventilation, drainage and professional certification. A Commencement Notice will normally be required before construction begins.

Each property must be assessed individually. The dwelling must remain connected with the principal property and cannot be sold separately.
